Terms and Conditions
1. Acceptance of Terms
These Terms and Conditions (the “Terms”) constitute a binding legal agreement between you (the “User”, “you”, or “your”) and DumboCart India, a company incorporated under the Companies Act, 2013, with its registered office at Kollam, India(hereafter referred to as “DumboCart”, “we”, “us”, or “our”).
By accessing www.dumbocart.in (the “Website”), creating an account, making a purchase, or using any of our services in any other way, you confirm that you have read, understood, and agreed to be bound by these Terms together with our Privacy Policy, Refund Policy, and Shipping & Return Policy. If you do not agree to any part of these Terms, you must stop using the Website and our services immediately.
2. Definitions
“Services” means the products, delivery services, and other offerings made available by DumboCart.
“Content” means all product descriptions, images, videos, and other materials provided through the Services.
“User” means an individual who has registered an account or made a purchase.
“Order” means a confirmed paid purchase made on the Website.
3. Eligibility
Our Services are intended for individuals aged 18 years or above who are competent to enter into a legally binding contract under the Indian Contract Act, 1872. Users under 18 may use the Services only with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms.
4. Account Registration & Security
You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that takes place under your account.
You agree to notify us immediately at support@dumbocart.in if you suspect unauthorized access to your account.
Only one account per individual is permitted; sharing of credentials with another person is prohibited and may result in suspension.
5. Orders, Pricing & Payments
All product prices listed on the Website are in Indian Rupees (INR) and, unless stated otherwise, are inclusive of applicable taxes. Pricing may change without prior notice; however, an Order that has been paid in full will be honored at the price effective at the time of payment.
Payments are processed through our authorized payment partner over a secure connection. We do not store full card numbers, CVV, or sensitive payment information on our servers.
An Order is treated as confirmed only after we receive successful payment confirmation from our payment partner.
You are responsible for any charges, currency conversion fees, or taxes imposed by your bank or card issuer.
In the event of a duplicate or erroneous payment, please contact us within 7 days for reconciliation.
6. Delivery & Access
Once your payment is confirmed, delivery of the relevant products will occur in accordance with our Shipping & Return Policy. Delivery timelines and prerequisites are described on the respective product page and in the order confirmation you receive after purchase.
Access is granted to the purchasing User only and is non-transferable.
7. User Conduct & Acceptable Use
While using the Website or our Services, you agree NOT to:
- Record, download, copy, redistribute, sell, or sub-license any Content without our written permission.
- Share your account credentials, product links, or other personal information with non-registered persons.
- Upload, post, or transmit any material that is unlawful, defamatory, obscene, harassing, or infringes on the rights of others.

Upon making a purchase, you are granted a limited, personal, non-exclusive, non-transferable license to access and use the Content for personal use only. Unauthorized use, reproduction, or distribution may result in termination of your account and may attract civil and criminal liability.
9. User-Generated Content
By submitting any feedback, comments, reviews, or other materials (collectively “User Content”) to the Services, you retain ownership of such materials but grant DumboCart a worldwide, royalty-free, non-exclusive, perpetual license to use, reproduce.
10. Refunds & Cancellations
All refund and cancellation requests are governed by our dedicated Refund Policy. Please review that policy carefully before placing an Order; by completing a purchase, you confirm that you have read and accepted its terms.
11. Product Quality & Disclaimers
DumboCart commits to delivering high-quality products; however, product satisfaction and outcomes depend significantly on the User’s engagement, proper use, and care of the purchased products. Accordingly:
- We make no guarantee regarding specific outcomes or satisfaction levels related to purchased products.
- Product descriptions and images are illustrative and may not fully represent the actual item received.
- Any statistics provided, including customer satisfaction rates, reflect aggregate historical data and may not be representative of individual experiences.
- The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, except as required by applicable law.
12. Limitation of Liability
To the maximum extent permitted under applicable law, DumboCart, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Services. Our total aggregate liability in respect of any claim, whether in contract, tort, or otherwise, shall not exceed the amount actually paid by you to DumboCart for the specific product or service giving rise to the claim during the twelve (12) months preceding the event.
13. Indemnification
You agree to indemnify, defend, and hold harmless DumboCart and its officers, employees, and partners from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your misuse of the Services; (c) your violation of any applicable law; or (d) your infringement of any third-party right.
14. Termination & Suspension
We reserve the right to suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful behavior, attempted to compromise the integrity of the Services, or otherwise acted in a manner that may cause harm to DumboCart or other users. Sections that by their nature should survive termination (including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law) will continue to apply.
15. Third-Party Services & Links
The Website may contain links to third-party websites, payment gateways, or services that are not owned or controlled by DumboCart. We are not responsible for the content, privacy practices, or terms of any third-party website or service. Your use of such third-party services is at your own risk and subject to their respective terms.
16. Force Majeure
DumboCart shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay is caused by circumstances beyond our reasonable control, including, without limitation, acts of God, natural disasters, pandemics, government action, internet or telecommunications failures, power outages, strikes, or war. Where such an event affects scheduled deliveries, we will use reasonable efforts to reschedule or provide alternative arrangements.

We may update these Terms from time to time to reflect changes in law, our services, or business practices. The “Last updated” date at the top of this page indicates the most recent revision. Material changes will be communicated via email to registered users and via a prominent notice on the Website. Your continued use of the Services after such updates constitutes acceptance of the revised Terms.
18. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. Subject to the dispute-resolution provisions below, the courts at Kochi, Kerala India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Services.
19. Dispute Resolution
In the event of any dispute, we encourage you to first contact us at support@dumbocart.in so that we may attempt to resolve the matter amicably within 30 days. If the dispute remains unresolved, it shall be referred to and finally resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996, by a sole arbitrator mutually appointed by the parties. The seat and venue of arbitration shall be [insert city], and the proceedings shall be conducted in English.
20. Severability & Entire Agreement
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
